1. Agree and Accept Terms and Conditions
    1. Welcome to use Tyrehood mobile application (Tyrehood Zone). Below Terms and Conditions (Tyrehood Zone Terms and Conditions) apply when Tyrehood provide services to you (when you use Tyrehood Zone services). Tyrehood Terms and Conditions may be updated from time to time without notification. Tyrehood will not inform you if there is any update. You can browse the link : https://www.tyrehood.com/zone/en/terms.html , for any updated version. Beisdes, whenever you use any services that is provided by Tyrehood, you and Tyrehood have to follow any guidelines and/or rules which may apply to that service. For those guidelines and/or rules are to be included in this Tyrehood Terms and Conditions. Tyrehood may also be bounded by other terms and conditions when providing other services. If you do not agree Tyrehood Terms and Conditions, or the country that you are staying does not condone any of the Tyrehood Terms and Conditions, you should stop using Tyrehood Zone application and other services provided by Tyrehood immediately.
    2. For clarification, requestor refers to a person who send out signal for help to resovle issue with their cars, including flat tyre.
    3. For clarification, offerer (whether it is a Tyrehood Zone user, or Tyrehood Zone Partner user) refers to a person who send out a offer to the requestor to resolve their issue with their cars, including flat tyre.
  2. Service Charge
    1. It is free for anyone who use Tyrehood Zone mobile application to send out signal for help, and/or offering help. But this free services may change depending on the change of Tyrehood business. If there is a change in service charge for using Tyrehood Zone mobile application, we will make an annoucement on our website at https://www.tyrehood.com/zone/en , and our facebook page, https://www.facebook.com/tyrehood.hk 2 months prior to the change. If there is a change in service charge, there will be update in the mobile application version on the day when service charge is released. You will be informed at the mobile application that there is a service charge.
    2. Besides the function as mentioned in part (i), there are other functions exists in Tyrehood Zone may require additional charges. If additional charges are required for the corresponding function, payment must be made before you can use the function.
    3. Tyrehood Zone may have functions that are free of charge for a certain period of time. After the period of time, payment is required in order to continue the function. If you do not make any payment, you cannot continue to use that function. Tyrehood will not inform you to make the payment in order to continue the function.
    4. The offer that you received in Tyrehood Zone mobile application (when you send out signal for help) comes from another Tyrehood Zone user and/or Tyrehood on-site rescue Partner. The offer is not necessary provided by Tyrehood. When you confirm and accept an offer in the Tyrehood Zone mobile application, it is an agreement between you (the requestor) and the offerer. You are required to pay the agreed price to the offerer or other things that you and the offerer have agreed on. Tyrehood will not intervene any discussion and agreement that you (the requestor) and the offerer made.
  3. Service Description
    1. Unless there is other official terms and condition, any additional or amendment for the existing Tyrehood Terms and Conditions (including new product release) applies to this Tyrehood Terms and Conditions. You understand and also agree that Tyrehood service is based on present situation. Tyrehood is not responsible for any unsaved or delivery mistake or transfer mistake or accidential removal of Tyrehood registered member account.
    2. Tyrehood reserves the right to stop all or parts of Tyrehood service for maintenance, update or other tasks that Tyrehood is deemed suitable without informing you.
    3. You are responsible to obtain and pay for any third party services (such as Internet fees) including advertisement publication or any other related fees in order to use Tyrehood service. You are also responsible to obtain the necessary equipment and technology in order to use Tyrehood service (which includes Tyrehood Zone mobile application).
    4. You agree that you will not copy or make any plagiarism of any Tyrehood service (and Tyrehood Zone mobile application, and your Tyrehood accout), for sales, trading, resales, or commercial purposes. You also agree that, unless there is other official specification, this Tyrehood Terms and Conditions do not consist of any third party beneficiary / stakeholder
    5. You agree that you will not abuse the use of Tyrehood Zone mobile application for other services that Tyrehood does not provide, such as selling tires to the other parties and/or selling other products or services that Tyrehood has not permitted you to do so, in which may lead to loss of Tyrehood business. Tyrehood will blacklist you, and ban you from using Tyrehood Zone mobile application without informing you. Your account will be locked or removed, and you will no longer able to use Tyrehood Zone mobile application even without a Tyrehood member account.
    6. You agree that you will not abuse the use of Tyrehood Zone mobile application to send out signal for rescue (that you do not need) and/or send out offer that you have no ability to provide. Tyrehood will blacklist your account without any notification, and you cannot continue to use any of the Tyrehood service (include Tyrehood Zone mobile application). Additionally, you may require to compensate any loss that the offerer/requestor incurred.
    7. Before you request any help using Tyrehood Zone mobile application, you should check your tire, including sidewall, if there is any crack, hole, or other situations that may make the tire unable to use, as it will affect your decision in choosing what kind of help you should receive. You should mention the situation as detail as possible at the remark field in Tyrehood Zone mobile application before sending any request for help such that other users understand and aware what kind of help you should be receiving. If you accept an offer, and the offerer has completed his job as required, you should pay the offerer as promised. Tyrehood only provide Tyrehood Zone mobile application for users to seek help and/or offer help in a more convenient way. Tyrehood will not make any payment to the offer that you have accepted.
    8. You agree and understand that you have the ability to provide the assistance to the requestor before sending out an offer to the requestor. When your offer is accepted by the requestor, you need to complete the offer as agreed on between you and the requestor. Tyrehood only provides Tyrehood Zone mobile application as a platform for user like you to seek assistance or provide assistance. If you cannot complete the offer, Tyrehood will not be responsible for it. It is your responsibility to complete the offer that you have agree with the requestor.
    9. You agree and understand that Tyrehood does not verify and confirm every Tyrehood Zone mobile application user detail. If you accept and confirm an (the offerer) offer but he/she does not fulfill his promise / complete the offer, Tyrehood will not provide further assistance in the offer, and will not compensate any loss. Likewise, if you accept and confirm a request but he/she does not fulfill his promise (such as not at the location as shown), Tyrehood will not help the requestor to pay and compensate any loss.
    10. You agree and understand that Tyrehood Zone mobile application is just a platform for anyone to seek for help and offering help. All user, including you, must be aware and ensure any rescue services, including changing spare tyre, and other services must be done in a safe environment. Tyrehood will not purchase any third part insurance to any user who uses Tyrehood service, including Tyrehood Zone mobile application user.
    11. Some free of charge services accesses are conditional. E.g. For Tyrehood customers who have purchased at least 6 tyres and above, and purchase a particular battery brand to gain access to it for a limited of time. These conditions may change due to business decisions, and Tyrehood will not inform you of such changes which will limit your access to Tyrehood Zone mobile applications functions.   4. Account Registration

    5. In order to use Tyrehood services (especially Tyrehood Zone mobile application service), you agree the following:

    1. You are required to fill in the most accurate personal data for account registration.
    2. You are required to maintain and update your account profile for the most accurate personal data. If your account profile data is outdated, incomplete, misleading, or contains data that is not relevant to the field required to fill in, or not relevant to your actual personal detail, Tyrehood may consider your account profile as oudated, incomplete, expired, misleading, or contains incorrect data. Tyrehood has the right to stop or terminate your account, and reject your access to all or some of the Tyrehood service indefinitely. Tyrehood is concern with all the user account safety and privacy.
  5. Tyrehood Service amendment
    1. Tyrehood has the right to amend, pause, or stop any of the Tyrehood service under any situation at anytime with / without informing you beforehand. You agree and accept that Tyrehood is not liable to you and any other third party because of any amendment, on hold, or termination of Tyrehood service,
  6. Termination
    1. You agree and accept that Tyrehood may consider your action have violated this Tyrehood Terms and Conditions based on any reason, consideration, and including but not limited to the frequency of using Tyrehood service at anytime, thus terminating part or all of your access to Tyrehood service (including Tyrehood Zone mobile application), as well as your Tyrehood membership account with / without informing you beforehand. All content related may be removed and deleted. Tyrehood may constantly check on person, who uses Tyrehood services (users), behaviour and terminate any users' access to parts or all of Tyrehood service at anytime when Tyrehood discovered that these users have violated Tyrehood Terms and Conditions with / without informing users beforehand. In addition, you agree and accept that Tyrehood is not liable to any of your loss or to any third party loss when Tyrehood terminate your access to part or all of Tyrehood services, including Tyrehood Zone mobile application and/or your Tyrehood membership account.
  7. Hyperlink
    1. Tyrehood or any Tyrehood users may provide hyperlink to access other webpages or resources. As these webpages or resources are provided by third party person, Tyrehood does not have any control to manage these webpages and resources. Tyrehood is also unable to stop you from accessing to these webpages and resources. You understand and accept that it is your decision to access these webpages and resources at your own risk. Tyrehood is not responsible to these webpages and resources content (content that includes advertisement, product, or other information). Allowing hyperlink posted on Tyrehood website and mobile application does not mean Tyrehood agree on all the content of these webpages and resources and Tyrehood is not responsible for the content of these webpages and resrouces. You also agree and accept that Tyrehood is not liable to any loss incurred when you access to these webpages and resources by clicking the hyperlink (which direct to third party websites) directly or indirectly.
  8. Disclaimer

    9. You understand and accept that:

    1. Tyrehood follows this Tyrehood Terms and Condition to provide Tyrehood services to you. The standard and level of service provided is based on the ability that Tyrehood staff can provide.
    2. Tyrehood and Tyrehood staff do not guarantee that: (a) Tyrehood services satisfy you and your needs; (b) Tyrehood services can be run smoothly without any problems and errors; (c) Tyrehood services provide absolute and reliable data and result; (d) The product or service or information or other resources that you purchase or obtain via Tyrehood services meets your expectation; (e) All errors can be resolved when you are using the software developed by Tyrehood or provided by Tyrehood's third party vendor
    3. You have considered and accepted the risk of downloading or obtaining anything via Tyrehood services (including Tyrehood Zone mobile application), and you are responsible for any error occurred and/or data loss.
    4. Any warning or advice from Tyrehood (or Tyrehood services) through oral communication or written communication does not mean Tyrehood grant or guarantee anything to you or any users, except there is any statement specified in this Tyrehood Terms and Conditions.
    5. A small number of users may experience epileptic seizures when exposed to certain light patterns or backgrounds on a computer screen while using the Service. Certain conditions may induce previously undetected epileptic symptoms even in users who have no history of prior seizures or epilepsy. If you or anyone in your family have an epileptic condition, please consult your physician prior to using the Service. Please immediately discontinue using the Services and consult your physician if you experience any of the following symptoms while using the service: dizziness, altered vision, eye or muscle twitches, loss of awareness, disorientation, any involuntary movement, or convulsions.
    6. The service provided by Tyrehood is provided on an "AS IS" and "AS AVAILABLE" basis and Tyrehood will not have any responsibility for the timeliness, deletion or failure to store any user communications or personalisation settings. Tyrehood disclaims all representations and warranties, express, implied or statutory, not expressly set out in this Tyrehood Terms and Conditions, including the implied warranties of merchantability, fitness for a particular purpose and non-infringement. In addition, Tyrehood makes no representation, warranty, or guarantee regarding the reliability, timeliness, quality, suitability, or availability of the services or any services or goods requested through the use of Tyrehood services, or that the services will be uninterrupted or error-free. Tyrehood does not guarantee the quality, suitability, safety, or ability of third party providers. You agree that the entire risk arising out of your use of the Tyrehood services, and any service or good requested in connection therewith, remain solely with you, to the maximum extent permitted under applicable law.
    7. As Tyrehood Zone mobile application is provided by Tyrehood as a platform for all Tyrehood users to help one another, Tyrehood does not guarantee the safety of all Tyrehood users, including you. You are responsible for your own safety, and provide your own service under safe environment. Tyrehood is not liable, and will not compensate any loss incurred because of your carelessness, mistake, or any other reasons.
    8. You agree that, except it is listed under Tyrehood Terms and Conditions, Tyrehood is not responsible to any of the Tyrehood users who use Tyrehood services, including Tyrehood Zone mobile application. Tyrehood will not provide or offer any assistance (which includes tyre patch, tow car, car rescue, or any kinf of assistance) to any of the Tyrehood users.
  9. Limitation of liability

    10. You understand and agree that, Tyrehood is not liable to pay any direct, indirect, incidential, sepecially, derivative, punitive compensation due to the below causes (which may result in your loss, including but not limited to profit, business reputation, uses, data loss, or other intangbile loss). (even if Tyrehood is told there is a possibility of loss and compensation required)

    1. the use of Tyrehood services (which also includes Tyrehood Zone mobile application) or unable to use Tyrehood services.
    2. purchase or obtain or trade any products, services, information or data, and/or information received, and/or any fees engendered in the process via Tyrehood services.
    3. any of your data edited or stolen by unauthorized person
    4. any of the third party users disclaimer or behaviour
    5. any of the related (Tyrehood services) issues , unless it is specified in this Tyrehood Terms and Conditions
    6. Tyrehood is not liable and responsible to any loss due to the following: (i) You use or trust Tyrehood services or you are unable to access Tyrehood services; or (ii) your transaction with any third party providers or relationship even if Tyrehood is told that there is a possibility of loss. Tyrehood is not responsible for any service delay or failure of providing service, especially when it is beyond the ability that Tyrehood can manage and control. You also agree, acknowledge and accept that Tyrehood users who offer helps may not have professional certificate.
  10. Compensation
    1. You agree that you are liable and will compensate to any loss (such as claim and expenses, fees like lawyer fees )that Tyrehood (including Tyrehood management team members, board of directors, employees, and agent) incurred , due to the following causes: (i) you obtain any products / services (that Tyrehood has not granted any permission to be sold / provided) via Tyrehood Zone mobile application;
      (ii) you sell any products/ services (that Tyrehood has not given any permission to be sold / provided) via Tyrehood Zone mobile application;
      (iii) you violate any of the Tyrehood terms and conditions;
      (iv) Tyrehood uses your content ; or
      (v) you violate any third party users (including other tyrehood services users) right.
  11. Tyrehood and its employees cannot guarantee
    1. Tyrehood Zone service can satisfy and meet your expecation
    2. Tyrehood Zone can operate and run smoothly without any problems / errors;
    3. Tyrehood Zone can provide safe and reliable services;
    4. Using Tyrehood Zone service can have reliable and accurate result;
    5. Any products / services / information / data you purchase / obtain via Tyrehood Zone service can meet your expecation;
    6. Any errors can be fixed and updated in the softare; and
    7. (Appearing in Tyrehood services that) Products and services by third party providers are legally sold / provided

    You have thought and bear the risk of downloading or in any other ways of obtaining any data / information which may causes data loss or system damanage, while using Tyrehood Zone services.

    You understand and agree that Tyrehood is not liable to any direct, indirect, or other forms of fine or compensation or loss of profit, or reputation or use or data loss or other intangible loss (even if Tyrehood has been informed before hand) due to the following reasons

    1. the use of Tyrehood service or unable to use Tyrehood service,
    2. Obtain or purchase of products, information and details through Tyrehood service that engenders substitute goods and cost.
    3. your data transferred or detail is obtained without your permission by another person / party
    4. Any third party's disclaimer and behaviour that is not in Tyrehood service or
    5. Other service that is not Tyrehood service (unless it's otherwise stated in this service terms and conditions)
  12. Communication / Notification
    1. Any means of notification will be done by email. If there is any update in this Tyrehood Terms and Conditions, Tyrehood may notify you with a hyperlink.
  13. Data Privacy
    1. Tyrehood Zone services will gather your personal data including but not limited to mobile number, credit card number, contact name, address, mobile phone data and so on when you use Tyrehood Zone service.
    2. Tyrehood will follow Personal Data (Privacy) Ordinance to manage your personal data.
  14. Governing law and jurisdiction
    1. These Terms shall be governed by and construed in accordance with the laws of Hong Kong. Both you and us agree to submit to the exclusive jurisdiction of the courts of Hong Kong as regards any dispute or matter arising under these Terms.
  15. Tyrehood Online Shopping platform service terms and conditions
    1. When you register as member at Tyrehood Zone webpage, you can use the account to access and patronize the online shopping platform developed by Tyrehood (https://www.tyrehood.com/en/index.php). You understand and aware that products and services sold at the online shopping platform are limited to customers in Hong Kong only, unless it is otherwise stated on the webpage. Terms and conditions apply for the access and use of Tyrehood webpage (https://www.tyrehood.com/en/index.php). You should access to https://www.tyrehood.com/terms.html (Chinese Version) or https://www.tyrehood.com/en/terms.html (English version) for the latest version of terms and conditions.

In case of any discrepancy between the English version and the Chinese version, the English version shall prevail.
